About the Disciplinary Panel

The Sport Integrity Disciplinary Panel Te Kahu Aratika (the Disciplinary Panel) makes decisions on:

  • whether someone has breached the Integrity Code or a policy made under the Integrity Code

  • whether there will be a sanction for any breach

  • the nature of any sanction

Appointments and independence

The Board of the Commission appoints the members of the Disciplinary Panel, including the Chair and Deputy Chair.

The Disciplinary Panel receives referrals of potential breaches of the Integrity Code from the Commission, but otherwise operates entirely independently from it.

Hearings

When an issue is referred to the Disciplinary Panel, the Chair or Deputy Chair will hold a hearing. The Disciplinary Panel can create its own rules for hearings - including rules about evidence - but those rules must be consistent with:

  • the principles of natural justice

  • the Integrity Code

  • the reasonable needs of the parties, including cultural considerations like tikanga Māori.

The Disciplinary Panel can also request information from or interview any of the parties.

Sanctions

Sanctions available to the Disciplinary Panel include requiring an organisation to suspend or exclude a participant from the relevant activity. The Disciplinary Panel doesn't have the power to fine or order compensation.

Te Ara Tukanga - The Disciplinary Panel appointment process

From time to time, the Commission will seek nominations for the appointment of members to an independent Disciplinary Panel, which will consider and determine breaches of the Code of Integrity for Sport and Recreation (the Integrity Code).   

To be eligible, nominees must: 

  • be of good standing in the community; and 

  • have relevant knowledge and experience which could include, but not be limited to experience in:

    • law;

    • tikanga Māori;

    • knowledge of sport and recreation activities and rules;

    • child safeguarding and protection; or

    • disciplinary processes. 

The membership of the Disciplinary Panel must reflect the diversity of Aotearoa New Zealand's sport and recreation sector. When we seek nominations, we therefore welcome and actively encourage applications from candidates who can bring their perspective and experience to this panel including:

  • women; 

  • Māori; 

  • Pacific peoples; 

  • disabled people; and 

  • rainbow people. 

The Board of the Commission is responsible for selecting members of the Disciplinary Panel.

Those seeking appointment to the Disciplinary Panel will be asked to complete a Nomination Form that requires: 

  • personal and professional details which will support an assessment of suitability. 

  • a copy of their passport or New Zealand’ driver’s licence. 

  • a cover letter explaining how their skills and experience meet the selection criteria 

  • a full curriculum vitae. 

All completed nominations will be considered by a group comprised of:

  • members of the Board of the Commission

  • the Chief Executive of the Commission

  • independent representatives from the sport and recreation sector and/or the wider community.   

This group will shortlist candidates who will then be interviewed by a panel comprised of both independent and Commission members. 

The interview panel will recommend candidates for appointment to the Board of the Commission.

The Board will have final responsibility for considering and confirming all appointments.
